Terms of Service

By accessing or using FlickClaw ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. Please review these Terms periodically for changes.

FlickClaw is an AI-powered animated wallpaper generation service. Our platform analyzes static images and generates smooth, seamless looping animations using artificial intelligence. The Service includes image analysis, effect application, loop generation, real-time preview, and export capabilities in various formats including WebM, MP4, and GIF.

The Service is provided through a web-based application and a REST API for developers. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content.

To access certain features of the Service, you must create an account. FlickClaw supports authentication via Google OAuth or email and password. By signing in with your Google account, you authorize us to access and store your basic profile information (name, email, and profile picture) as provided by Google. When using email and password authentication, your password is securely hashed and never stored in plain text.

You are responsible for maintaining the security of your account and any activities that occur under your account. You must immediately notify FlickClaw of any unauthorized use of your account. FlickClaw shall not be liable for any loss or damage arising from your failure to comply with this section.

FlickClaw operates on a credit-based system. Each animation generation consumes credits based on the complexity and quality of the output. Credits can be obtained through our subscription plans or promotional offers.

All payments are processed securely through our payment providers. Prices are listed in US Dollars and are subject to change with notice. Refunds are handled on a case-by-case basis — unused credits from monthly subscriptions do not roll over unless explicitly stated.

Free Plan: Includes 5 one-time credits, up to 3 animations per day, 720p export resolution, 4 basic effects, watermarked output, and community support.

Pro Plan ($9/month): Includes 50 credits per month, up to 20 animations per day, 1080p export resolution, all 15 effects, no watermark, API access (10 requests/minute), and priority email support.

Enterprise Plan ($29/month): Includes 200 credits per month, up to 100 animations per day, 4K export resolution, all 15 effects, no watermark, full API access (20 requests/minute), priority queue processing, and dedicated support.

Plan features and pricing are subject to change. We will provide notice before modifying your current plan terms. Downgrading may result in loss of access to premium features and content generated under the higher tier.

You retain all ownership rights to images you upload to FlickClaw. The animated wallpapers generated from your images are yours to use, distribute, and modify as you see fit.

FlickClaw owns all rights to the Service itself, including but not limited to the software, algorithms, AI models, user interface, design, and branding. You may not reverse-engineer, decompile, or disassemble any part of the Service.

You grant FlickClaw a limited, non-exclusive license to process your uploaded images solely for the purpose of providing the Service. This license terminates when you delete your images or account.

You may not use FlickClaw to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. This includes but is not limited to:

• Generating imagery depicting violence, self-harm, or illegal activities

• Creating content that harasses, bullies, or intimidates individuals

• Producing sexually explicit or pornographic material

• Generating content that infringes on the intellectual property rights of others

• Using the Service to create deepfakes or misleading media

• Attempting to circumvent rate limits, credit systems, or security measures

• Using the API for automated spam or abuse

We reserve the right to suspend or terminate accounts that violate these prohibitions without refund.

The Service is provided on an "as-is" and "as-available" basis. FlickClaw does not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We do not provide any Service Level Agreement (SLA) for the Free tier.

Pro and Enterprise plans include a best-effort availability target of 99.5% uptime. Scheduled maintenance windows will be communicated in advance when possible. We are not responsible for outages caused by factors beyond our control, including but not limited to natural disasters, internet service provider failures, or third-party API disruptions.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will immediately cease.

FlickClaw may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. We will attempt to provide notice before termination when practicable.

Upon account termination, we will retain your data for a reasonable period to allow for potential reactivation, after which it will be permanently deleted in accordance with our Privacy Policy.

To the fullest extent permitted by applicable law, FlickClaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.

In no event shall FlickClaw's total aggregate liability exceed the amount you have paid to FlickClaw in the twelve (12) months preceding the claim.
